Terms of Service

1. Overview

These Terms of Service ("Terms") govern your access to and use of Nest App (the "Platform"), a construction services marketplace operated by Nest Provision Construction ("we", "us", "our"). By creating an account or making a purchase, you agree to these Terms.

2. Eligibility and accounts

You must be at least 18 years old and legally able to enter into contracts. You are responsible for keeping your login credentials confidential and for all activity under your account. Notify us immediately at contact@nestgeneralservices.company if you suspect unauthorized access.

3. How the marketplace works

1. Browse — you review verified Pros by trade, location, rating, and starting price.
2. Book — you pay through our payment processor to reserve the Pro for your job.
3. Schedule — the Pro contacts you, typically within 24 hours, to confirm date, scope, and site access.
4. Complete — the Pro performs the work and you approve it in a final walkthrough.

4. Pricing, fees, and payment

Prices shown are starting rates for the listed trade. The final price is confirmed after the Pro's on-site assessment, since scope, materials, and site conditions vary. Any change in price must be agreed between you and the Pro before additional work begins.

A platform fee is displayed separately at checkout before you pay. All amounts are in U.S. dollars (USD) unless stated otherwise.

Payment processing

Payments are processed by Whop, our third-party payment processor. We do not collect, store, or have access to your full card number, CVV, or bank credentials. Your payment is subject to Whop's own terms and privacy policy in addition to these Terms.

Credits

You may purchase credit packs to pay for services on the Platform. Credits:

• are denominated in USD and applied to service purchases on the Platform;
• are not legal tender, not redeemable for cash, and carry no interest;
• are non-transferable between accounts;
• may include promotional bonus amounts, which are non-refundable.

Refunds of purchased credits are handled under our Return & Refund Policy.

5. Your responsibilities as a Client

• Provide accurate job descriptions, address, and site access.
• Ensure the work area is reasonably safe and accessible.
• Obtain any authorization required from a landlord, HOA, or co-owner.
• Communicate scope changes to the Pro before work proceeds.

6. Pro obligations and verification

Pros listed as "Verified" have represented to us that they hold the licenses and insurance required in their jurisdiction, and have passed our onboarding checks. Verification is a good-faith screening at a point in time — it is not a guarantee of current licensure, insurance status, workmanship, or outcome. We encourage Clients to confirm license and insurance details directly with the Pro before work begins.

7. Prohibited use

• Using the Platform for unlawful purposes or to arrange unpermitted work.
• Circumventing the Platform to avoid fees after being introduced to a Pro through it.
• Submitting false, fraudulent, or misleading information, reviews, or payment data.
• Scraping, reverse-engineering, or interfering with the Platform's operation or security.
• Harassing, threatening, or discriminating against any Pro, Client, or staff member.

8. Disputes between Clients and Pros

The service contract for the work itself is between you and the Pro. If a dispute arises, contact us at contact@nestgeneralservices.company and we will make reasonable efforts to mediate, including reviewing job records and payment history. We may, at our discretion, issue a refund or credit under our Return & Refund Policy.

9. Disclaimers

The Platform is provided "as is" and "as available", without warranties of any kind, whether express or implied, including merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Platform will be uninterrupted or error-free, nor do we warrant the quality, safety, timing, or legality of services performed by any Pro.

10. Limitation of liability

To the maximum extent permitted by law, Nest Provision Construction shall not be liable for indirect, incidental, special, consequential, or punitive damages, or for lost profits, revenue, or data, arising out of or relating to your use of the Platform.

Our aggregate liability for any claim relating to the Platform shall not exceed the greater of (a) the total amount you paid through the Platform in the twelve (12) months preceding the event giving rise to the claim, or (b) USD $100.

11. Indemnification

You agree to indemnify and hold harmless Nest Provision Construction, its officers, and staff from any claim, damage, or expense (including reasonable legal fees) arising from your use of the Platform, your breach of these Terms, or your violation of any law or third-party right.

12. Suspension and termination

We may suspend or terminate your account at any time for breach of these Terms, suspected fraud, chargeback abuse, or conduct that harms other users. You may close your account at any time by contacting us. Sections that by their nature should survive termination (including Sections 9–11) will survive.

13. Changes to these Terms

We may update these Terms. Material changes will be reflected by a new "Last updated" date on this page and, where appropriate, notice to your account email. Continued use after changes take effect constitutes acceptance.

14. Governing law and venue

These Terms are governed by the laws of the Commonwealth of Massachusetts, United States, without regard to its conflict-of-law principles. You and Nest Provision Construction agree to submit to the exclusive jurisdiction of the state and federal courts located in Massachusetts for any dispute arising out of or relating to these Terms or the Platform.

Nothing in this section limits consumer protections that cannot be waived under applicable law, including rights under Massachusetts General Laws Chapter 93A.
